Abstract

L’étude des conditions carcérales a, dans la littérature, servi de prisme à l’examen de la mise en pratique de la justice et à la dénonciation de ses égarements. Il s’agit ici d’éclairer la phase amont du processus judiciaire, à savoir la création et l’application de la politique pénale par les tribunaux. Le cas français paraît particulièrement pertinent pour jauger la justice de la justice.

En effet, l’équité que la République française érige comme principe et valeur de sa Constitution et donc comme norme de justice universelle est loin d’être, dans la pratique, l’étalon qui prévaut à la répression pénale. Les institutions judiciaires dysfonctionnent au niveau géographique. À délit égal, les tribunaux français condamnent plus lourdement les régions les plus défavorisées.

Conciliant les approches critiques et quantitatives dans la lignée des Critical Quantitative Geographies, cet article apporte une preuve quantifiée de l’échec des institutions françaises qui sont, in fine, productrices d’injustices spatiales. L’inadéquation entre les flux de délits et la distribution des moyens pour y répondre pousse le système à rompre subrepticement avec la norme proclamée de justice distributive.

Abstract

Published research into prison conditions has served as a prism for examining judicial procedures and denouncing miscarriages of justice. This present study will shine new light on the phase leading up to the judicial process, namely the creation and application of criminal policy by the courts. The French context appears particularly relevant for gauging how just the justice system is.


Though equity has been established by the French Republic as a principle and tenet of its Constitution and thus as a norm of universal justice, in practice, it falls short from being a maxim that prevails over penal repression. Dysfunction in judicial institutions is found to vary according to area, with French courts condemning the same offense more heavily in the most disadvantaged regions.


Conciliating critical and quantitative approaches in the vein of Critical Quantitative Geographies, this article provides substantiated evidence of the failure of French institutions revealed in short, to be authors of geographical injustice. The inadequacy of the distribution of means to contend with the constant flow of crime, drives the system to surreptitiously break with the proclaimed standard of distributive justice.
